Buying and Selling Terms and Conditions
RSH Marine (“the Broker”) acts as an intermediary between boat owners (“the Seller”) and potential buyers (“the Buyer”). These terms govern all brokerage transactions facilitated by RSH Marine.
Role of the Broker
RSH Marine operates solely as a broker and does not own, inspect, or guarantee the condition of any vessel listed for sale. All information provided about boats is based on details supplied by the Seller.
Buyer’s Responsibilities

Buyers are strongly encouraged to conduct their own due diligence, including viewing the boat, commissioning a professional marine survey, and undertaking a sea trial before finalizing a purchase.

All brokerage boats are sold “as seen” unless otherwise agreed in writing.

Seller’s Responsibilities

The Seller must provide accurate details regarding the vessel, its condition, legal ownership, and any encumbrances (such as outstanding finance or liens).

The Seller must notify RSH Marine of any changes in the boat’s condition during the brokerage period.

It is the Seller’s responsibility to ensure the vessel is clean, presentable, and in a suitable condition for viewings and marketing.

​Any known issues, defects, or mechanical faults must be disclosed to RHS Marine prior to listing to ensure accurate representation in all marketing materials. Failure to do so may impact the sale process and could result in legal consequences.

No Automatic Right to Refund

As brokerage sales typically involve private transactions, UK consumer protection laws, including the 14-day cooling-off period, do not apply.

Once a Buyer agrees to purchase a boat and funds are transferred, the sale is final.

Refunds are only considered in cases of proven misrepresentation or breach of contract.

Deposits & Payment Terms

Buyers may be required to place a deposit to secure the boat. If the Buyer withdraws without just cause, the deposit may be forfeited.

Full payment must be completed before the boat is transferred to the Buyer.

Liability Disclaimer

RSH Marine makes no warranties or guarantees regarding the condition, title, or seaworthiness of any boat.

Buyers and Sellers agree that RSH Marine shall not be liable for any losses, damages, or disputes arising from the sale.

Dispute Resolution

Any disputes between Buyer and Seller should be resolved directly. RSH Marine may facilitate discussions but is not responsible for enforcing agreements.

Legal disputes shall be governed by the laws of England and Wales.

Amendments & Acceptance

RSH Marine reserves the right to amend these terms at any time.

By engaging RSH Marine’s brokerage services, both Buyer and Seller acknowledge and accept these terms.

Exclusive Brokerage Agreement
​ By listing your boat with RHS Marine, you agree to an exclusive brokerage arrangement. This means your vessel cannot be listed for sale with any other broker while under contract with us.

If you wish to withdraw your boat from RHS Marine’s brokerage services, you may do so after five months at no cost. However, if you choose to cancel earlier or decide not to proceed with RHS Marine after signing this agreement, a cancellation fee of £350 will apply.

Media Ownership
All photos and videos taken by RHS Marine for the marketing and promotion of your vessel remain the property of RHS Marine unless otherwise stated in writing. These materials may be used for advertising, listings, and future promotional purposes, even after the boat is sold or removed from the market.
Vessel Access & Liability
The Seller grants RHS Marine access to the vessel, with permission from the marina, for the purpose of valuation, viewings with potential buyers, and other necessary brokerage activities.

RHS Marine takes all reasonable care when accessing the vessel but accepts no responsibility for any damage, loss, or misuse that may occur during or as a result of viewings, valuations, or other access related activities. It is the Seller’s responsibility to ensure their vessel is secure and adequately insured.
